Common Questions About the E-2 Investor Visa for Canadians
Yes. Canada has a qualifying treaty with the United States, so Canadian citizens who invest in and direct a U.S. business are generally eligible to apply, provided the investment and ownership requirements are met.
There's no fixed legal minimum. The investment must be "substantial" relative to the type of business — enough to show a real commitment and to reasonably ensure the business will succeed. What counts as substantial for a small consulting practice looks very different than for a restaurant or manufacturing operation, which is why we assess this case by case.
Yes. Purchasing an established U.S. business can qualify for the E-2 visa as long as you hold at least 50% ownership (or otherwise control the enterprise) and can show the investment is active, at-risk capital rather than a passive purchase.
E-2 visas for Canadian citizens are typically issued for up to five years and can be renewed indefinitely as long as the underlying business continues to operate and meet E-2 requirements. There is no set limit on the number of renewals.
Yes. Spouses of E-2 visa holders can apply for work authorization and are permitted to work in the U.S. in any field. Children under 21 may attend school but are not authorized to work.
Not directly. The E-2 is a nonimmigrant visa, so applicants must maintain intent to return to Canada at the end of their authorized stay, even though the visa itself is renewable indefinitely. Some E-2 investors later pursue a separate path to permanent residence; we can discuss whether that fits your goals.
