Applicants must make a substantial investment that is sufficient to ensure the business’s success and is fully committed and at risk.
The business must also be real and operational, meaning it is actively engaged in commercial activities and not a speculative or passive venture.
The enterprise cannot be marginal; it must generate enough income to support the investor and contribute to the U.S. economy through job creation or economic growth.
Employee must have a job offer from a U.S. employer in a specific professional occupation covered by the TN visa category.
Employee must possess the necessary qualifications, which often includes a relevant bachelor’s degree or appropriate professional certification.
U.S. employer must provide a letter detailing employee's job offer, including job title, description, salary, employment duration and other details.
Beneficiary must invest at least $800,000 in a regional center or $1,050,000 in a new commercial enterprise that will create or preserve at least 10 full-time jobs for US workers.
The funds for the investment must come from a lawful source, such as personal savings, inheritance, sale of property or business, or a gift.
Beneficiary must also meet the admissibility requirements for the US, including no criminal history, no prior immigration violations, and no medical conditions that would render them inadmissible.
The position must be in a specialty occupation that requires specialized knowledge and at least a bachelor’s degree or equivalent.
The employer must pay the prevailing wage, ensuring the salary meets industry standards for the role.
The applicant must have qualifying credentials, including the necessary degree or equivalent experience in the specific field related to the job.
The U.S. business must be operational and actively engaged in commercial activities, demonstrating a viable business structure that aligns with the L-1 visa requirements.
The applicant must be employed in a managerial or executive role or possess specialized knowledge at a foreign company with a qualifying relationship to the U.S. employer.
The applicant must have been employed by the foreign company for at least one continuous year within the past three years.
