E-2 Requirements

The business is real and operational or on the verge of being operational.

The business must be an active for-profit business and not just passive income.

The investment in the business is substantial.

The investment must be put at risk in the US.

Beneficiary must own at least 50% of the business and maintain managerial control.

The business income must not be marginal nor barely sufficient to support the Treaty Investor as well as their family.

Beneficiary must maintain all qualifications throughout the validity of the E-2 Visa.

TN Requirements

Employee must have a job offer from a U.S. employer in a specific professional occupation covered by the TN visa category. These occupations typically require at least a bachelor’s degree or appropriate professional credentials.

Employee must possess the necessary qualifications, which often includes a relevant degree or professional certification.

U.S. employer must provide a letter detailing your job offer, including job title, description, salary, employment duration and other details.

Employee will need to submit a TN visa application at a U.S. consulate or embassy in Canada or at a designated U.S. port of entry.

E-B5 Requirements

Beneficiary must invest at least $1,050,000 (or $800,000 in a Targeted Employment Area) in a new commercial enterprise that will create or preserve at least 10 full-time jobs for US workers.

The funds for the investment must come from a lawful source, such as personal savings, inheritance, sale of property or business, or a gift. The beneficiary must provide evidence of the source of funds, including bank statements, tax returns, and other financial documents.

Beneficiary must also meet the admissibility requirements for the US, including no criminal history, no prior immigration violations, and no medical conditions that would render them inadmissible.

H1-B Requirements

Beneficiary must have a bachelor’s degree or higher in a specific field.

Beneficiary’s job must require a bachelor’s degree or higher in a specific field.

Beneficiary must be able to demonstrate that beneficiary has the necessary qualifications and experience for the position.

Beneficiary must have a job offer from a U.S. employer who is willing to sponsor beneficiary’s visa application.

The employer must pay beneficiary the prevailing wage for the position.

L-1 Requirements

Employer must have a qualifying relationship with a foreign company (parent company, branch, subsidiary, or affiliate).

Employer must be currently doing business, or will be doing business, in the United States and at least one other country during the duration of the beneficiary’s stay in the United States.

Employer must file a petition for a non-immigrant worker (Form I-129) on behalf of the beneficiary.

Beneficiary must have worked for the qualifying foreign company for at least one year in the past three years in an executive, managerial, or specialized knowledge capacity.
